(AP) — A bill to outlaw the use of cesspools in Minnesota will be sent to Republican Gov. Mark Dayton for his signature after the Legislature approved it on Tuesday. The final vote was 77-54 in the House and 29-21 in the Senate, with supporters calling for a nationwide standard and opponents decrying such an outright ban as unworkable. The state's current requirements are voluntary and do not go into effect until July 2015. The bill would ban the use of the open-air toilets that are a lingering eyesore in rural Minnesota and are a leading source of water pollution in the state. The bill was supported by the Minnesota Pollution Control Agency and a group of rural communities. Democratic Rep. Joe Hoppe, the bill's main sponsor, said opponents were concerned about enforcement but said he was confident in the agency's ability to enforce the law. "A giant, ugly cesspool is no longer a part of Minnesota's rural landscape," Hoppe said. Minneapolis resident Michael Caligiuri attended the hearing in the House Environment and Natural Resources Committee, where he acknowledged the damage cesspools can cause. "It's one thing to understand what the problem is, but it's another thing to look at it in a town like this and feel like it's a somewhat personal thing," Caligiuri said. The United States has no national standard for the disposal of sewage, and numerous local bans on the practice are currently in effect in Minnesota and Iowa. A bill to ban the open-air toilets in Massachusetts was stalled earlier this year, while attempts to pass similar legislation in Illinois, New York and other states have also died.
